Terms of Service
Last updated:
These terms are the agreement between qr2dine, 30 N Gould St, Ste 48771, Sheridan, WY 82801, United States (“we”, “us”), and you, the restaurant, cafe or other business that creates a qr2dine account (“you”). By creating an account, you agree to them, and you confirm you are allowed to agree on your business’s behalf.
Diners who read a menu on qr2dine don’t have an account and are not a party to these terms. Our Privacy Policy explains how we handle personal information.
1. The Service
qr2dine lets you build an online menu for your restaurant, publish it at its own web address, and share it with a QR code. Diners can read the menu on their phone. We may improve and change the service over time; if we remove something important that you pay for, we’ll tell you in advance.
2. Your Account
- Give us accurate information and keep your email address up to date.
- Keep your password safe. You are responsible for what happens in your account; tell us right away at [email protected] if you think someone else has used it.
- You must be at least 18 years old to create an account.
3. Subscription Plans
qr2dine has two Subscription Plans. The Free plan costs nothing and has limits on how many Categories, Menu Items and Theme Presets you can create. The Premium plan removes those limits and adds features, for the price shown when you subscribe. You can pay for Premium monthly or yearly; both include the same features. The current limits, features and prices are listed on our site. To protect the service, every plan, Premium included, also has fair-use limits on how many Categories, Menu Items and Theme Presets a restaurant can have, set far above what a real menu needs; if yours needs more, write to us.
4. Billing, Renewal and Cancellation
- Premium is paid in advance through Stripe, monthly or yearly, and renews automatically at the end of each billing period (a month or a year), charging the card on file, until you cancel. We email you a reminder 30 days before a yearly subscription renews.
- You can cancel anytime in the Stripe Customer Portal, which you reach from the dashboard’s Subscription page. Premium then stays active until the end of the period you have paid for, and your account moves to the Free plan after that.
- In the same portal you can switch between monthly and yearly billing. A switch to yearly takes effect right away, and the unused part of your current month is credited toward the yearly price; a switch to monthly takes effect at the end of the year you have paid for.
- Yearly payments: 14-day refund. If you cancel within 14 days after a yearly payment, whether it is your first payment or a renewal, we refund that payment in full, and your account moves to the Free plan when we do.
- Apart from that, we don’t give refunds for partial periods, including when you cancel or delete your account in the middle of a period.
- If a payment fails, Stripe will try again for a while; if it still fails, your account moves to the Free plan. On the Free plan, anything above its limits stays saved but is hidden from your menu, and your menu shows the default theme, until you upgrade again.
- Prices may include sales tax where it applies. We may change the price of Premium; we’ll tell you by email at least 30 days before a new price applies to you, and you can cancel before then.
5. Your Menu Content
You own the content you put on qr2dine: your restaurant’s name and logo, menu text, prices and photos. You give us permission to store it, display it publicly on your menu and in previews of the service, and make copies needed to run qr2dine (for example, resized photos and backups), for as long as it is in your account.
You are responsible for your menu: Its content, prices and allergen information must be accurate and kept up to date. This includes anything you copy from our Template Library: its items, descriptions, allergens and photos are generic starting points, and once you add one to your menu it is yours to check and correct. Diners rely on your menu, especially for allergens; we don’t check it.
You confirm that you have the rights to everything you upload, and that it doesn’t break anyone else’s rights or the law.
6. Publicity
On our website, in marketing materials and on social media, we may name your restaurant as a qr2dine customer and show its logo, and tag or mention it in our posts. We never publish quotes from you or figures about your business without your permission.
You can ask us to stop at any time from our contact page. We then remove your restaurant’s name and logo from our website and stop using them in new material within a reasonable time; posts already published may remain.
7. Acceptable Use
Don’t use qr2dine to:
- Publish anything illegal, misleading, hateful or sexually explicit.
- Sell or advertise things that are illegal where you or your diners are.
- Pretend to be a business you don’t represent.
- Upload malware, or try to break into, overload or disrupt the service or other accounts.
- Scrape the service or other restaurants’ menus in bulk, or resell qr2dine.
We may remove content that breaks these terms, and suspend or close an account that breaks them seriously or repeatedly. Where we can, we’ll tell you first and give you a chance to fix it.
8. Copyright Complaints
If you believe something on qr2dine infringes your copyright, email [email protected] with: the work you believe is infringed, the link to the content, your contact details, a statement that you believe in good faith the use isn’t authorized, a statement that your notice is accurate and that you are the owner or allowed to act for the owner, and your physical or electronic signature. We’ll remove infringing content and close the accounts of repeat infringers.
9. Ending Your Account
You can delete your account at any time in the dashboard’s Account settings. This deletes your restaurant, its menu and photos for good and cancels an active Premium subscription right away, without a refund for the rest of the period except for the 14-day refund on yearly payments (see section 4). We may close the service or your account with 30 days’ notice by email, or right away for a serious breach of these terms. If something outside our control, such as a court or government order, makes us close the service sooner, we’ll tell you as soon as we can.
10. Disclaimers
qr2dine is provided “as is” and “as available”. We work to keep it running and your data safe, but we don’t promise it will always be available, free of errors, or fit for a particular purpose, to the extent the law allows.
We announce planned maintenance in advance, but an outage can happen without warning. We don’t refund or extend a subscription for the time qr2dine was unavailable.
11. Limitation of Liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data, arising from your use of qr2dine. Our total liability for any claim about the service is limited to the amount you paid us in the 12 months before the claim, or $100 if that is more.
We are not responsible for a delay or failure caused by events beyond our reasonable control, such as an outage at our hosting or network providers, a natural disaster, war, or a court or government order.
You agree to cover our losses and costs from claims by others, including diners, that arise from your menu content or from your breaking these terms.
12. Governing Law
These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws rules. Disputes will be handled by the courts there.
13. Changes to These Terms
We may update these terms. We’ll change the date at the top of this page and, for important changes, email you at least 30 days before they take effect. If you keep using qr2dine after that, the new terms apply; if you don’t agree, you can cancel and delete your account.
14. Transfer
If qr2dine is sold or merged with another company, we may transfer these terms and the accounts under them to the new owner.
